English Summary
Thiruvananthapuram: Pinarayi Vijayan has launched a sharp criticism against former Governor Rajendra Arlekar’s recommendation to remove the Chairman and members of the Kerala Public Service Commission (PSC). He alleged that the Governor’s action constitutes a violation of constitutional provisions and an abuse of power. Pinarayi also demanded that the state government’s stance on the matter be made clear.
The political controversy intensified following reports that the former Governor had submitted a recommendation to President Droupadi Murmu, seeking the removal of Kerala PSC Chairman M.R. Baiju and the commission’s members. Reports suggest that this recommendation stems from allegations of irregularities concerning the PSC’s operations and an ensuing investigation.
Pinarayi Vijayan pointed out that members of the Public Service Commission are appointed under Article 316 of the Constitution of India. He noted that the tenure of commission members is six years, and that any removal prior to the completion of this term must follow the procedures stipulated under Article 317.
Pinarayi argues that the constitutional process—which requires an inquiry by the Supreme Court into complaints regarding the misconduct of members, followed by a report recommending their removal—must be strictly adhered to. He alleged that no such Supreme Court inquiry into the members of the Kerala Public Service Commission (PSC) has taken place, and therefore, the former Governor’s recommendation lacks any constitutional basis.
In his critique, Pinarayi also referred to Article 163, which stipulates that the Governor must act in accordance with the advice of the Council of Ministers.
Pinarayi Vijayan stated that it is not customary to replace the incumbent PSC Chairman and members whenever a government changes; rather, the standard practice is to appoint new members only as the terms of the existing ones expire.
He further alleged that an attempt is being made to undermine the credibility of the entire Commission based on allegations of irregularities concerning a single appointment. He pointed out that over the last decade, the PSC has played a pivotal role in facilitating government appointments for hundreds of thousands of candidates.
Pinarayi Vijayan questioned what position the UDF government intends to take regarding the Governor’s recommendation. He demanded that the government clarify whether it supports the Governor’s action or is prepared to condemn it.
Pinarayi also alleged that the Central government uses Governors to interfere with the federal powers of the states. He urged that political bias be set aside and that constitutional provisions be upheld in the matter concerning the PSC.
The recommendation to remove the PSC Chairman and members is not a final decision. Further actions by the President and adherence to established constitutional procedures will be critical in this matter. Pinarayi Vijayan’s criticism regarding the Governor’s recommendation, along with the allegations linked to it, has paved the way for a political controversy.
